IntelliChief trademarks are valuable corporate assets that play an important role in promoting IntelliChief and its products and services. However, they may be weakened or lost altogether by improper use. These Trademark Usage Guidelines ("Guidelines") set forth how to properly acknowledge and preserve the trademark rights of IntelliChief. These guidelines apply to all IntelliChief resellers, strategic business partners, customers, advertising agencies, consultants, professional writers and editors, licensees and to third parties making reference to IntelliChief trademarks.
If you have any questions concerning the information in these Guidelines, please contact Brian Smith, Director of Marketing, at 120 Forbes Boulevard, Mansfield, Massachusetts 02048, or (508) 594-2800.
Approved Use
You may use IntelliChief trademarks to refer to IntelliChief's products and services, so long as the trademarks are used properly in accordance with these Guidelines. Use of IntelliChief trademarks not in accordance with these Guidelines or of marks that are confusingly similar to IntelliChief trademarks may constitute an infringement of IntelliChief's rights.
You may NOT use IntelliChief logos, logotypes or design marks without prior written consent from IntelliChief.
Proper IntelliChief Trademark Attribution
All IntelliChief trademarks must be properly attributed. Trademark ownership is attributed in two ways, with the use of a trademark symbol (TM) after the trademark, and with a trademark legend, usually placed at the end of a document in "mouseprint" directly after the copyright notice.
Trademark Symbols:
The appropriate trademark symbol must be used when making reference to any IntelliChief trademarks. The appropriate symbol for each of IntelliChief's trademarks is indicated on the IntelliChief Trademark List below. If a product or trademark is not listed, please contact the IntelliChief marketing department.
- ® indicates a trademark registered in the United States, which is either a trademark or a registered trademark in all other countries where it is used.
- TM indicates a trademark that is presently unregistered.
- SM indicates a service mark that is presently unregistered.
Wherever possible, the symbol should be placed directly after the trademark, in a superscript and in a size smaller than the mark itself. If you are unable to use the symbols due to the software you are using, you should use parenthetical versions as follows: (R), (tm), or (sm)
The trademark symbol does not need to be included in every use of the trademark. The trademark symbol must always be used:
- Upon the first use of the trademark in the text of each document or in any other materials referencing an IntelliChief trademark.
- On all prominent uses of the trademark (e.g. title pages, headings, etc.) - unless space and style criteria prevent such markings.
Trademark Legends:
IntelliChief trademarks and products must be properly identified as originating from IntelliChief by including a brief statement (legend) attributing ownership of these trademarks to IntelliChief. The following legend should be used on all materials that reference IntelliChief trademarks:
IntelliChief, [list IntelliChief trademarks/products referenced in the materials], are trademarks or registered trademarks of IntelliChief or its subsidiaries in the U.S. and in other countries.
In addition:
- The trademark legend must be clear in order to avoid any confusion over who is the owner of each mark.
- IntelliChief trademarks should be specifically credited and not referred to generically as "...all other trademarks are owned by their respective companies." or similar language.
- Do not use or add any other statements to the legend that in any way suggests that you have or are claiming any rights in a IntelliChief trademark.
- Do not reference a IntelliChief trademark and another company's trademark in the same trademark legend. For example, it is improper to say, "IntelliChief™ and IBM® are trademarks...". Rather, use separate legends, one for IntelliChief trademarks (as above) and one for IBM's marks (e.g. "IBM is a registered trademark of IBM Inc. ").
The legend is usually placed at the end or bottom of marketing materials. In documentation, the notice should be placed in the title page or, when the documentation is on-line, in the about section. The trademark notice may be in a smaller font than the text of the document (i.e. "mouseprint") but it must be legible. Generally 6 point font is the minimum acceptable size.
Proper Usage of IntelliChief Trademarks
IntelliChief trademarks are adjectives (brand names) modifying nouns (the generic product type). Please adhere to the following when using IntelliChief trademarks:
- The first use of any IntelliChief trademark in text must be as a proper adjective. Use a generic term in association with each IntelliChief trademark the first time the mark appears. For example, IntelliChief paperless process management solutions. It is acceptable to not use the generic noun intermittently after the first use.
- Keep IntelliChief trademarks distinctive from surrounding text and use consistent IntelliChief lettering, font and design format. For example: use IntelliChief™, not intellichief or Intellichief.
- Do not make IntelliChief trademarks possessive through the use of apostrophes. For example, use the "functionality of IntelliChief™" instead of "IntelliChief's functionality".
- Do not pluralize IntelliChief trademarks.
- Do not abbreviate or combine IntelliChief trademarks. For example, use IntelliChief™ not IC.
- Do not hyphenate IntelliChief trademarks and do not allow them to break across a page line when used in text.
- Avoid confusion by clearly separating and identifying IntelliChief trademarks from other company's names and/or trademarks.
